Attorneys from the national workplace law firm of Jackson Lewis LLP will provide an information packed session on the ever-expanding array of legal issues occupational health professionals must consider when designing and implementing workplace wellness programs. Our speakers will review the major legal issues that arise with incentive-based wellness plans, particularly those designed as part of a group health plan. The presenters will discuss the use of health risk appraisals/questionnaires and behavior management and the legal risks under HIPAA, ADA, state disability/lifestyle discrimination laws, and state privacy claims. Among other things, participants will learn about:

  • When HIPAA applies to wellness programs
  • HIPAA’s impact on the amount of incentives employers may offer in covered wellness programs
  • The new Healthcare Reform law and its effect on wellness programs

  • State laws that could impact wellness initiatives
  • Potential defenses to state claims under ERISA
